Abstract

Smart working, regulated in the Italian legal system by Law 81/2017 and which during the health emergency due to the coronavirus COVID-19 pandemic has assumed particular characteristics in order to limit the spread of infections, calls into question the structure of the traditional employment relationship (e.g. about working time, workplace, employer powers, protection of privacy and right to disconnect), implying an afterthought of both the management of human resources and the company organization as a whole.
A comparative survey of the main European legal systems is crucial, on the one hand, with the goal of understanding how smart working has evolved over the past few years. On the other hand - principally - with the aim of finding and correlating the best practices in the areas of labour law protection and management of the remote working relationship, safety at work and safeguarding the job market.
