The article deals with the State aid to credit institutions within the new legal framework
of the Bank Recovery and Resolution Directive and other relevant EU Regulations. The
article considers also the Communications issued by the EU Commission and in particular
the Communication 2013 which has provided a much more rigorous interpretation of the
State aid rules which had been given in the aftermath of the financial crisis of 2008 a more
flexible approach. The article concludes that too much discretion has been given to the EU
Commission and that a legislative reform is needed.
